AI CAN TRANSFORM LEGAL WRITING, BUT LAWYERS STILL HAVE TO DO THE THINKING

Lawyers who think generative AI is a paragraph factory, or out to replace them, are mistaken, says a Stetson Law professor who teaches one of the nation’s first courses in AI legal writing.
“The real goal here is to learn, train, read, experiment safely, and figure out where in your writing process this works best for you,” says Kristen Davis, a professor and Provost’s Faculty Fellow for Generative Artificial Intelligence and Higher Education at Stetson University College of Law.
Davis joins Practice Resource Center Director Christine Bilbrey and Practice Management Advisor Jamie Moore in a free, hourlong CLE, Navigating the Future of Legal Writing: Generative AI’s Impact and Ethical Considerations for Attorneys | LegalFuel.
Learning the distinction between a Google search and an AI prompt can unlock a tool that will enhance the speed and accuracy of legal writing, reduce costs for clients, and allow lawyers to devote more time to “client care” or their own health and wellness, Davis assures.
Davis stresses that lawyers should understand the technology’s strengths and weaknesses to avoid violating client confidentiality or running afoul of their other ethical responsibilities.
No technology is perfect, she warns, and for all of its amazing abilities, generative AI still lacks consistency.
“I can put in the same prompt 10 times and not get the same results,” she says. “Even AI scientists don’t know exactly how generative AI works to generate its responses, and we need to be concerned about that.”
The best approach, Davis advises, is to consider AI a writing partner.
“That is really the key for lawyers, engaged use as a collaborator or an assistant.”
